01Acceptance of terms
These Terms of Service (“Terms”) are a binding agreement between you and Village (“Village,” “we,” “us,” or the “Company”) governing your access to and use of the Village website, application, and related services (together, the “Service”). By creating an account, purchasing a subscription, or otherwise using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
02The service
Village simulates audience reactions. You provide text or files — for example a pitch, application, essay, message, or ad — and the Service generates responses from AI-simulated personas, including reactions, scores, discussion, and summaries (“Output”). The Service is a creative and analytical tool for pressure-testing your work before you share it with a real audience.
Plans differ in usage allowances and features. Current plans, prices, and limits are described at tryvillage.io/upgrade and may change as the Service evolves.
03Eligibility & accounts
You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to purchase a subscription; minors may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms.
You are responsible for your account, for the accuracy of the information associated with it, and for all activity that occurs under it. Sign-in links and sessions are personal to you; do not share access. Notify us promptly at support@tryvillage.io if you suspect unauthorized use of your account.
04Your content
You retain all ownership rights in the text, files, and other material you submit to the Service (“Your Content”). You grant Village a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate, provide, secure, and improve the Service. Your Content — including your conversations with personas — is private to your account. We do not use Your Content to train AI models, and we do not sell it.
You are solely responsible for Your Content. You represent that you have all rights needed to submit it and that it does not violate any law or the rights of any person, including confidentiality obligations, intellectual-property rights, and privacy rights. Do not submit content that is unlawful, or that contains another person’s sensitive personal information without their permission.
05AI-generated output — no advice, no guarantees
Output is generated by artificial intelligence. The personas in the Service are fictional simulations — they are not real people, and they do not represent, speak for, or predict the views of any real individual or organization. Any resemblance to real persons or organizations is coincidental. Village is not affiliated with, endorsed by, or connected to Y Combinator or any other accelerator, investor, university, employer, or platform referenced in your use of the Service; all trademarks belong to their respective owners.
Output is probabilistic and may be inaccurate, incomplete, inconsistent, or biased. Scores and reactions are simulated estimates, not measurements or predictions of real-world outcomes.
Output is provided for informational and creative purposes only. It is not professional advice of any kind — including legal, financial, investment, admissions, employment, medical, or business advice — and it is not a prediction or guarantee of any outcome, including acceptance to any program, funding, sales, grades, or offers. You are solely responsible for decisions you make and actions you take based on Output.
06Acceptable use
In connection with the Service, you agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- attempt to probe, scan, breach, or test the vulnerability of the Service or its authentication, or access data or accounts that are not yours;
- reverse engineer, decompile, scrape, crawl, or harvest the Service or Output at scale, or use automated systems to access the Service except through interfaces we provide;
- circumvent, or attempt to circumvent, usage limits, plan entitlements, or rate limits, including by creating multiple accounts;
- abuse free allowances, promotional credit, grace periods, or payment flows, including repeated sign-ups, disputed charges made in bad faith, or use of stolen payment instruments;
- resell, sublicense, or offer the Service or Output as a competing service, or misrepresent Output as the views of real people;
- generate or submit content that is defamatory, harassing, infringing, or otherwise unlawful, or use the Service to deceive or defraud others;
- interfere with the operation of the Service or impose an unreasonable load on our infrastructure.
We may investigate violations and may suspend or terminate accounts engaged in them, as described in Section 12.
07Subscriptions, billing & usage limits
Billing
Paid plans are billed in advance on a recurring basis (monthly, or yearly where offered) through our payment processor. By subscribing you authorize us and our payment processor to charge your payment method the applicable fees, plus any taxes, at the start of each billing period. Prices are stated in U.S. dollars.
Automatic renewal
Subscriptions renew automatically at the end of each billing period until cancelled. Your payment method is charged at each renewal at the then-current price for your plan. We will provide notice of price increases before they apply to you.
Cancellation
You may cancel at any time from Settings → Billing in the app, which opens the billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then. Except as provided in Section 8, fees already charged are not refunded or prorated upon cancellation. If you have difficulty cancelling, contact support@tryvillage.io and we will help.
Usage limits
Every plan, including paid plans, is subject to usage allowances and fair-use limits that protect the Service for everyone. Allowances reset on the schedule shown in the app, do not roll over, and have no cash value. We may adjust allowances, model selection, and processing behavior to maintain quality and cost of service.
08Refund policy
Village offers a limited, no-questions-asked grace period on every new subscription so you can evaluate the Service risk-free. Once the applicable grace period has elapsed, all charges become strictly final and non-refundable, as described below.
Grace period — no questions asked
If you are not satisfied with the Service for any reason, you may request a full refund of your initial subscription charge within the following window, measured from the date of the initial charge:
- Yearly subscriptions: thirty (30) calendar days from the initial charge.
- Monthly subscriptions: forty-eight (48) hours from the initial charge.
Grace-period refunds are available one (1) time per person and apply only to the initial charge of a new subscription — not to renewal charges, plan switches, or upgrades. Reinstating a cancelled subscription does not create a new grace period.
After the grace period — no refunds
Once the applicable grace period has elapsed, all payments are strictly final and non-refundable. You acknowledge and agree that after the grace period you are not entitled to any refund, credit, or reimbursement for any reason.
Without limiting the above, refunds will not be granted after the grace period for: service outages, maintenance, or degraded performance of any duration; dissatisfaction with Output, scores, or simulated feedback; outcomes of decisions made using the Service; unused time or unused usage allowance; changes to features, models, limits, or pricing; inability to access the Service due to your device, network, or account issues; change of mind, non-use, or forgotten cancellation; account suspension or termination for violation of these Terms; or events outside our reasonable control.
How to request a grace-period refund
Email support@tryvillage.iofrom the email address on your account within the applicable window, with the subject “Refund request.” Approved refunds are issued to the original payment method and typically settle within 5–10 business days, depending on your bank.
Chargebacks
You agree to contact us to resolve any billing issue before disputing a charge with your bank or card issuer. Initiating a chargeback on a charge that complies with these Terms is a material breach of this agreement; we may suspend or terminate the associated account and may contest the dispute with evidence of use and acceptance of these Terms.
Statutory rights
Nothing in this section limits rights that cannot be waived under the mandatory consumer law of your place of residence (for example, in the EU and UK, certain withdrawal rights for digital services — which you acknowledge may be affected when you request immediate access to the Service). Where such law applies, this policy operates in addition to, not instead of, those rights.
No implied rights
No refund promise exists outside this section. Any goodwill refund we choose to issue in a particular case is discretionary and does not create a right to future refunds or a modification of this policy.
09Intellectual property
The Service — including its software, design, personas system, branding, and all content we provide other than Your Content and your Output — is owned by Village or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal or personal purposes in accordance with these Terms. No other rights are granted.
As between you and Village, and to the extent permitted by law, you own the Output generated from Your Content and may use it for any lawful purpose, subject to Section 5 (it may not be represented as the views of real people) and to third-party rights in material you supplied.
If you send us feedback or suggestions, we may use them without restriction or compensation.
10Third-party services
The Service depends on third-party providers — including cloud hosting, AI processing infrastructure, authentication, and payment processing. Their availability and conduct are outside our control, and your use of third-party services (for example the hosted checkout and billing portal) may be subject to their own terms. Links to third-party sites are provided for convenience; we are not responsible for their content.
11Service availability & modifications
We work to keep the Service available and fast, but it is provided without any uptime commitment. The Service may be interrupted by maintenance, updates, provider outages, or events beyond our control. We may add, change, or remove features, models, or plans at any time, and may discontinue the Service entirely with reasonable notice where practicable.
12Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you materially breach these Terms, create risk or legal exposure for us or other users, or where required by law. Upon termination your license to use the Service ends; sections that by their nature should survive (including Sections 5, 8, 9, and 13–18) survive termination.
13Disclaimer of warranties
The Service and all Output are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. Village does not warrant that the Service will be uninterrupted, secure, or error-free, or that Output will be accurate, reliable, or fit for your purposes. Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, exclusions apply to the maximum extent permitted.
14Limitation of liability
To the maximum extent permitted by law, Village and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or opportunities, arising out of or relating to the Service or these Terms — including damages arising from decisions made in reliance on Output — even if advised of the possibility of such damages.
To the maximum extent permitted by law, Village’s total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid to Village in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars ($50).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, the above limitations apply to the maximum extent permitted.
15Indemnification
You will defend, indemnify, and hold harmless Village and its officers, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to Your Content, your use of the Service or Output, or your violation of these Terms or of any law or third-party right.
16Dispute resolution, arbitration & class waiver
Informal resolution first
Before filing a claim, you agree to contact us at support@tryvillage.io with a written description of the dispute and to attempt in good faith to resolve it informally for at least thirty (30) days. Most concerns can be resolved this way, quickly and for free.
Binding arbitration
Any dispute not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English, by a single arbitrator, with any in-person proceedings held in the county where you reside or another mutually agreed location. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Service.
Class action and jury waiver
You and Village each waive the right to a jury trial and the right to participate in a class action, class-wide arbitration, or representative proceeding. Disputes will be resolved only on an individual basis.
If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than in arbitration.
17Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except where the mandatory consumer law of your residence applies. Subject to Section 16, the state and federal courts located in California will have exclusive jurisdiction over any dispute not subject to arbitration.
18General terms
- Entire agreement & severability. These Terms and the Privacy Policy are the entire agreement between you and Village regarding the Service. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the rest remains in effect.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- No waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
- Electronic communications. You consent to receive notices and communications from us electronically, at the email on your account or through the Service.
- Time limit on claims. To the extent permitted by law, any claim arising out of the Service must be filed within one (1) year after the claim arose, or it is permanently barred.
19Changes to these terms
We may update these Terms from time to time by posting the revised version on this page and updating the date above. For material changes we will provide notice through the Service or by email where feasible. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
